Ricardo Gómez viene prestando servicios en la empresa DIDACTICA, S.A., desde el 15 de octubre de 2005, como jefe de ventas. Si bien, desde el 10 de abril de 2011 se encuentra en situación incapacidad temporal por depresión. El día 20 de septiembre de 2011 Ricardo salió a comprar el periódico y se encontró con su amigo Alejandro Salinas quien le invitó a comer y a pasar el día en su nueva casa. Ricardo, aunque no se encontraba muy animado, tras la insistencia de su amigo, acudió agradecido. Lo cierto es que Alejandro acababa de comprar una casa que estaba reformando, por lo que Ricardo decidió ofrecerle su ayuda. Ésta consistió en cargar más de 20 sacos de cemento, así como otros materiales de construcción, que se encontraban almacenados en el exterior de la vivienda para introducirlos en la misma; operación que le ocupó aproximadamente dos horas.

Al día siguiente Ricardo decidió volver a la casa de su amigo para continuar prestándole su ayuda. A lo largo de la mañana retiró parte de los escombros que se encontraban en el interior de la vivienda y los depositó en un contenedor situado frente a la misma. Ese día, aunque estaba bastante agotado, Ricardo le dijo a su amigo Alejandro que si lo necesitaba para cualquier tipo de actividad relacionada con la reforma de su casa podía contar con él. Alejandro le indicó que la semana siguiente le llamaría para que siguiera ayudándole.

El día 28 de septiembre de 2011 Ricardo recibió una carta de despido, con efectos desde el día siguiente, en la que se señalaba que había realizado tareas incompatibles con su situación de incapacidad temporal, que habían impedido su recuperación y, por tanto, la consiguiente reincorporación a su puesto de trabajo. En concreto, se le imputaban los siguientes hechos corroborados por Doña. Esperanza Lozano, Gestora de Talento Humano:

“Haber conducido su vehículo propio el día 20 de septiembre de 2011 y haber realizado tareas de carga y descarga los días 20 y 21 del mismo mes”.

Rosa Silvano también viene prestando servicios en la misma empresa desde el 1 de febrero de 1988 en el cargo de auxiliar administrativo. El 27 de septiembre de 2011, uno de los trabajadores de la empresa comunicó al jefe de sección que su despacho había sido forzado y, además, que le habían robado un computador portátil que le había proporcionado la empresa para realizar su trabajo, así como material de oficina y varios objetos personales. El vigilante de seguridad de la empresa, que se encuentra situado en la puerta de salida de la misma, fue advertido ese día de la necesidad de revisar las carteras y bolsos de todos aquellos que entraran y salieran. Rosa, justo cuando salía de la empresa, fue requerida por el vigilante de seguridad para que le mostrara los objetos que ella misma portaba. En ese momento, sin oponer ningún tipo de resistencia, Rosa dejó encima de la mesa del vigilante de seguridad un paquete de folios, una carpeta, una caja de rotuladores y tres cuadernos; todo ello con sobres y fólderes de la empresa y marcados con el logotipo de la empresa y cuyo valor total ascendía a 720.000/pesos. A todos los empleados de la empresa se les había indicado la prohibición de utilizar material de oficina para su uso personal; aunque Rosa pensó que el hecho de que usara el citado material no podía tener demasiada importancia, sobre todo teniendo en cuenta su escaso valor.

Dos días más tarde, la empresa a la vista de lo establecido en el REGLAMENTO DE TRABAJO, en el que se tipifica este tipo de conductas como falta muy grave susceptibles de ser sancionadas con despido, traslado y suspensión del contrato, procedió ese mismo día, el 29 de septiembre de 2011, a comunicar su despido a Rosa.



CUESTIONES:
