Una de las trampas del quehacer histórico es apelar al uso de generalidades, tal es el caso de lo que suele denominarse: la herencia colonial o legado colonial. Dentro de este, se suele ubicar a la economía, así como las estructuras sociales y mentales. Su rasgo más característico es siempre poseer un significado negativo. La etapa virreinal es el periodo sobre el que quizás existen más prejuicios; su imagen suele ser oscura o gris, predomina así una historia negra de la colonia (1). Lo cual, quizás se deba a que a la colonia o virreinato se le suele atribuir los grandes males republicanos.
Es innegable que durante esta etapa existieron condiciones muy injustas y despreciables; sin embargo, no podemos quedarnos con una mirada incompleta sobre esta época de nuestra historia. Haciendo una analogía, vale recordar una declaración del famoso historiador Jacques Le Goff, sobre el supuesto carácter “oscurantista” de la Edad Media:
Aquellos que hablan de oscurantismo no han comprendido nada. Esa es una idea falsa, legado del Siglo de las Luces y de los románticos. La era moderna nació en el medioevo. El combate por la laicidad del siglo XIX contribuyó a legitimar la idea de que la Edad Media, profundamente religiosa, era oscurantista. La verdad es que la Edad Media fue una época de fe, apasionada por la búsqueda de la razón. A ella le debemos el Estado, la nación, la ciudad, la universidad, los derechos del individuo, la emancipación de la mujer, la conciencia, la organización de la guerra, el molino, la máquina, la brújula, la hora, el libro, el purgatorio, la confesión, el tenedor, las sábanas y hasta la Revolución Francesa. Salvando las distancias, creo que algo similar pasa con nuestra etapa virreinal. El sesgo es siempre negativo y no se reconoce el valor de algunos elementos recibidos desde la península ibérica. Vale la pena entonces mencionar algunos de ellos, así como cuestionar las ideas equivocadas que existen sobre este periodo. La intención no es construir una historia dorada o indulgente sobre la colonia, sino tratar de escapar de los lugares comunes de la historia tradicional y el imaginario peruano.
Instituciones del virreinato
Los hispanos trajeron numerosas instituciones a América. Se crearon también instituciones ad hoc para la administración de las colonias o provincias. Tal es el caso del Real y Supremo Consejo de Indias ubicado en la metrópoli española, y cuyas leyes representaron una de las legislaciones más modernas de su época. En los virreinatos por su parte, se crearon los cabildos o municipios, herederos de una larga tradición europea de gobiernos locales: Roma, Germania, ciudades-república italianas, etc. En España, los municipios de Castilla y León fueron totalmente autónomos, se autogobernaron; representando una temprana y auténtica democracia directa. Según Francisco Miró Quesada, antes de la conquista de América, los hispanos ya habían logrado grandes avances en el gobierno de sus ciudades: igualdad ante la ley, inviolabilidad del domicilio, garantías procesales, participación de la cosa pública, derecho de los vecinos a elegir libremente a los magistrados concejales y la responsabilidad política de los funcionarios municipales (3). Esta estructura de gobierno local (ayuntamiento) se reprodujo en América, llegando incluso a ejercer funciones de gobierno y administración de justicia. Lamentablemente esta institución decaerá, a partir de la introducción de la nefasta costumbre de vender los cargos públicos, en vez continuar con las tradicionales elecciones. Sin embargo, lo que había sido una institución controlada por peninsulares pronto se abrió a criollos y mestizos, haciéndolos parte del régimen municipal. Hacia 1812, gracias a la constitución liberal de Cádiz, se refundaron los cabildos, y estos optaron nuevamente por la elección de sus autoridades. Estas comunidades locales serán las que proclamen la independencia en los próximos años, siendo por lo tanto los lugares donde se incubó la democracia y la libertad de América. (Miró Quesada: 2007)
