The fundamental freedoms’ approach, within the human rights framework, entails that the equal opportunity for participation, training, and coexistence is set up as a priority. It emphasizes the importance of recognizing the human being particularities from the conditions of their culture, race, gender and sex in order to obtain a full development. Examining the public policies underlying educational inclusion of people with disabilities in Colombia constitutes the objective of this work of reflection. The human rights approach and inclusive approach were used to analyze the principles of fairness, equality and collating opportunities as these tend towards the participation, inclusion and integral development of the population. Therefore fairness and equality invite to democratize politics as a project of shared identity, the policies should have an individual and collective moral responsibility where the essential basis is the recognition and respect of otherness. Both principles express universality; this means taking into account all the interest and needs of the marginal populations.
